The CD Checks Are In The Mail -- Finally!

SEATTLE - It's seven months late, but finally, the checks are in the mail!

We're talking about the refund checks from the big CD price-fixing settlement.

Consumers were supposed to get their refunds last July, but money back is not the only promise the government made.

The settlement fell under the radar of a lot of consumers, but Sang Cho of Lake Forest Park is ready for his share.

Under the terms of the settlement, just over $67 million in cash goes to consumers. And more than $75 million worth of CDs goes to schools, libraries and other groups -- of which $1.5 million go local groups.

The consumer payback part comes to $13.86 a person. The 213,000 that filed for the claim in our state should get their checks within the next week or so.

But what about reason for lawsuit in the first place?

When the feds sued four years ago, they claimed the industry was overcharging us and that the settlement would lower CD prices by as much as $5.

We checked around, and distributors and retailers have dropped prices.

For example, Nora Jones' new release "Feels Like Home" is $11.99 at Circuit City, $14.99 at Target and $13.99 at Tower Records -- all much better than they typical new release price four years ago.

And there's more fluctuation.

Melissa Etheridge's "Lucky" is $10.99 at Circuit City, $11.99 at Tower and $14.99 at Target. But you can still pay close to $20 at some other locations.

Josh Groban's "Closer" was $12.99 at Circuit City, $14.99 at Target and $18.99 at Tower.

But industry experts say lower prices are probably more due to competition from the Internet and consumer downloading than the price fixing lawsuit.

Sang Cho says whatever the reason, and whatever the refund, he's glad to see the system work for the consumer -- even if it's 7 months late.

"You know, I spent the time to fill out all the forms and follow it through, so I'll take it," he said.

I have been waiting for so long. Add this to the amount I can get for me bottles and cans, and I'll have over 20 dollars! Woohoo!

Yeah, I'm going to use my check to buy enough blank CDs to archive all of my old vinyl albums.

Since I'm not buying any new music, I may as well make some old favorites that I never repurchased useable again.

Um, Target has a stupid pricing policy it seems. A flat $14.99 across the board does nothing to promote new albums or increase sales of new albums. Plus they then have to price match with competitors, which comes right out of their margin. Duh, maybe they should look into that.

Prices may not be lower, but it looks like they're fluctuating between retailers instead of being a flat $15.99-$18.99 across the board. If you want to get a better deal, you can shop around for it now. I'm still waiting for $5-$6 albums.

Price fixing has stopped? Since when??

Let's see there are how many LEGAL sites to download songs now, and all of them charge 99cents per download. How is that NOT fixing prices??

Again, overpricing by $5 per disc means the RIAA cartel has ILLEGALLY earned $22.5 BILLION!!! What was their punishment for this crime? $61 million plus $75 million and legal fees? WHAT A JOKE!!

They need to be brought up on price fixing again, and this time seriously punished. But I doubt our Department of Justice would even bother. They got paid off enough money from the RIAA labels last time to not bother with this for years. Imagine how much money the RIAA could bribe our government officials with after getting a $22.5BILLION windfall!!! What a joke our legal system has become.

I'm not holding my breath...

...BUT, if in fact I do get a whopping $13.86 for the over 2 grand I spent on CDs during that time, I'm getting another bottle of Bailey's Irish Cream...and drink to the demise of the RIAA.

The best part of this settlement deal, IMO, is the part where they must donate 5.5 million CDs (good CDs, not overstock cutout crap) to schools and libraries in the 41 states who joined the suit. I estimate our local public library should get 200 or more new CDs, if they receive a fair pro-rated share. Now that's a lot of free music for us all to listen to, and the RIAA won't benefit one penny from it. Hooray!

I urge you to contact your local public library and make sure they are aware of this part of the settlement -- they can contact their state atty general's office to find out if your state was part of the lawsuit, and how to collect their free CDs.

That said, each member of our family bought CDs during the lawsuit period, and I filled out forms for each one of us, so we will get three checks -- about $40 or so. Very nice. A small compensation for the ripoff, but better than nothing.

guess I'll using mine to finally go buy a CD after over a year of not buying one...will go get LOS LONELY BOYS...a Non RIAA album...Los Lonely Boys, by Los Lonely Boys...to give you an idea of their sound, it is like Santana meets Stevie Ray Vaughn meets 50s do-opp....
