Court Orders New Protections for People Targeted by RIAA
The controversy arose after the music industry filed a flood of lawsuits against anonymous individuals whom the industry claimed were sharing copyrighted music. Because the industry did not know the identities of the individuals, it served subpoenas to the individuals' ISPs seeking their names. The court held that before the ISPs turn over these names, they must send notices to the individuals advising them of their rights. This allows a targeted individual to make an intelligent decision about what steps to take before his or her identity is disclosed.
The Electronic Frontier Foundation (EFF), Public Citizen, the national American Civil Liberties Union (ACLU) and the ACLU's Pennsylvania affiliate participated in the case as friends of the court. The organizations have been heavily involved in protecting the right to anonymous speech and ensuring that people sued for copyright violations are made aware of their rights.

I don't think its a problem of not knowing their rights. I think its the knowlege that the RIAA has more money and will keep you in court till you run out. Then they win. |

And are these people receiving legal counsel? Is the RIAA being challenged in any court? Is there an update on the NJ (Michele Simeca ?) woman who did not settle? |

I'd like to see a copy of one of these letters... other than this, I was thinking this may be a step in the right direction as far as people learning how to fight back against this brick wall... time will tell if it does anything for anyone. |

I love the fact that they are using the RICO act against the RIAA. I've seen copies of letters that they have sent people, and they are extortion. I hope we can follow this suit and see what happens. Any idea as to when it's scheduled? |

Meanwhile, the RIAA sued another 750 "John Doe" defendants on Thursday, including 25 who are accused of using university networks to share copyright music. The 13 schools targeted include Grinnell College, Hamilton College, Indiana State University, Iowa University and the University of Wisconsin at Oshkosh, among others.
The music labels also filed an additional 213 lawsuits against named defendants who had been identified during the legal process. Those defendants either refused or ignored the music companies offers to settle the case before proceeding, according to a RIAA statement. |

Has anyone read Hillary Rosen's article in this months wired?
The softer, gentiler Hillary is now acting like many of the concessions to Artists (Prince, etc...) are because the RIAA wants to give back some control to the artist, seeing it is a good thing and the right thing to do.
Does anyone believe that?
The truth is, artists have gotten wiser aren't letting the big labels push them around. As soon as artists speak up and labels are forced to conceed, they want to take credit saying the concessions were their idea all along.
