May the Force Be With Napster?

On the heels of Dr. Dre giving Napster, Inc. an ultimatum to remove listings from their directory service that refer to his songs he was slapped with a lawsuit by Lucasfilm LTD. for copyright infringement.

Lucasfilm has alleged that Dr. Dre, who is using the THX "Deep Note" in his album Chronic 2001, is infringing on the trademarked sound, which is the first sound to have ever been trademarked. Dr. Dre had previously asked for permission to use the sound and was subsequently denied the right to use it. Even though he was not granted permission, Dr. Dre went ahead and used the sound in the beginning of his most recently released album.

Seeking unspecified damages, the suit reads, in part, "Defendants willfully copied and used Lucasfilm's THX Deep Note without consent, by recording, producing, distributing, advertising, selling, and/or offering for sale infringing works and products incorporating Lucasfilm's protected THX Deep Note, and have caused said infringing works and products to enter into commerce and/or be transported or used in commerce."

As of late Wednesday, Dr. Dre has not been served with actual legal papers and Interscope records, one of the named defendants, offered no comments.

The timing of this is certainly ironic seeing as just yesterday Dr. Dre himself issued an ultimatum to Napster, Inc. advising them to remove his song listings from their directory service otherwise he would take possible legal action. Seeing as he was upset with the fact that his copywritten works were possibly being infringed upon, he sought necessary action in order to remedy that. Lucasfilm LTD has seen that their copywritten material is being infringed upon they too sought the necessary action to ensure that it is remedied as well. One can only speculate what was going through the minds of the legal department at Lucasfilm and wonder if this move had been planned for some time, or if there was any relation to the actions that Dr. Dre took upon Napster. I would be interested to see what Lucas, himself, thinks of applications like Napster.

Is this an odd coincidence or the work of a stronger force...

I guess Lucasfilm is trying to say is..if your gonna sue Napster for copyright infgingement, then I guess we can now sue you for your copyright infringement.
The way I look at it is if they wanna be assholes, then they're gonna get fucked. We'll now he's getting fucked, and now i feel better! Now somebody should sue Metallica, maybe i will for false advertisement...(yeah, we tough rebels against the system now we act like the system..)POSERS!!!!!!

HA HA!!!!! Dre has got coming what he deserves. But that's bad to say, cuz im a Dre fan. But maybe this will wake him up and he would let Napster be.

Listen.... if the prices were so fucking high for Cd's then there wouldn't be a need for napster. DId u know it costs a company like Sony or some other jabroni less than $2 to make and release a cd? And they sell for almost $20!!! Let Napster be...

Lucasfilms, LTD. has also issued a recent complaint to a web site about using their THX sound (at least a monthe or more before this happened). Perhaps, they are just on a streak of protecting their trademarks now that Episode One is calming down.
Still, the timing is quite ironic, and perhaps their just teaching Dr. Dre a lesson in hypocrisy.

Are Metallica hipocrites or what? I seem to remember in the early 80s that every bootleg cassette tape i came across had METALLICA on it...As i remember they were the kings of the underground record and tape traders...They are a bunch of spoiled pussys...DIE METALLICA

Well,,everyone I'm "was" a hardcore metallica fan
back before metallica got big,,,everything I had from them was bootleg...BTW,,they handed out tapes at there concerts

Seems that Metallica, while a popular band, is losing some fans because of this. They need to realize that it is time to embrace free music, not denounce it!
