MP3.com and Universal Head to Court

Today is the day that MP3.com and the Universal Music Group head off to court. The trial is to decide whether MP3.com violated copyrights with the use of their my.mp3.com service. If the jury finds in favor of Universal, damages could be as much as $150,000 per violation.

Back in April, a judge ruled that MP3.com had indeed violated copyrights with their my.mp3.com service, but before damages had been set in the case the company settled its dispute with four (EMI, Warner Music, BMG, and Sony) of the five major labels. (Leaving only Universal to remain.) Financial terms of the settlements were not disclosed, but sources said each label was to get between $15 million and $25 million for settlement.

With today as the pending court date between the two parties, we will have to see if a last minute settlement can be reached.

Universal are being pretty pig headed.

It's not because of MP3.com's violations of anything that they aren't settling, it's that they have a competing product soon to be released or something.

I was just going to post a message on the main board asking if Heidi or anyone knew what Universal's hangup was. Do you know something you haven't told us yet? :)

Is it possible that they could win, yet be awarded less than the 4 other settlements? Let's face it, they won't lose. The other settlements will work against mp3.com in the decision making, but I'm hoping it works against Universal monitarily. Too bad I think the point will be lost on them either way.

That is a really good question and I was actually looking into that when writing the article. I haven't come up with anything yet, but the only logical reason I can think of is that they are holding out for more money. What makes them think they are better than the other four major labels? You tell me.
