Electric Gypsy Rolls Over (and Plays Dead)
The following is "fallow-up" to my earlier pissed-off rant: "Van Morrison Hate's Covers (READ IT FIRST SO YOU HAVE CONTEXT TO GO BY!) --Shmoo
After a lot of research, consultation, "testing of the winds and waters" ...and self preserving thought, my band Electric Gypsy sadly decided to DECLINE on the option of fighting back against the Van Morrison DMCA take down notice we received via YouTube. --Shmoo
Sure, the EFF will 'rise to the well publicized occasion' to fight for "fair use/parody" rights when a baby this cute dances to an obviously RIAA copyrighted music background...
...but, (I guess) copyright laws have the EFF's hands tied when it comes to any cover tunes (even when they make NO USE WHATSOEVER of the actual sights and sounds associated with a recording of the song.)
Long story short, the EFF doesn't seem to want to play ball with my case. (lol, maybe Fred is mad at me for accidentally calling him "Eric" so many times over the years!)

Ray Beckerman was no help either. I contacted him about what was happening with a mild request that he'd help 'slashdot' the story and all I got in reply was a snide remark (at least it seemed that way to me) essentially saying [paraphrased] "I thought you guys were 'independent' musicians" ...which, I took to mean that because I have a band that sometimes does "covers" that somehow excludes me from being "indie" in his book. (I could be mis-reading him, but his reply was VERY short and 'snippy' IMHO.)

I tried putting my story past several other prominent blogger's and 'netizens' ...WITHOUT much reply.
...Nobody wants to help spread the story about the following facts it seems:

Universal and YouTube have a "Strategic Partnership" (...meaning that Universal is getting a huge share of YouTube's ad revenue in return for not suing WHILE supposedly YouTube users are allowed to use stuff from Universal's catalog in their videos. (Meanwhile: the YouTube user's who do choose to use said material in their videos have NO CLAIM on any portion of that ad revenue!)

If I were to press the issue and file a "counter claim" against the DMCA take-down of that silly cover song, (that me and my band really don't care all that much about) I would then likely end up in court in a real life legal battle where I would be accused of willful copyright infringement and have to face extremely well funded lawyers WITHOUT even pro-bono support.
Even though I follow news and things about copyright law very very closely, I am NOT a lawyer myself. I'd have to "go it alone".
(I wouldn't stand a snowball's chance in hell!)

Me and the band talked it over. It's just not worth it. We MIGHT have been swayed to "fight" had we gotten more support from the "blogosphere" and "digital/copyright fighters" who are out there on the net. But we DIDN'T.
Besides. Our "video" of that damn recording was JUST a single (and unimpressive) still photo of our band on top of the FIRST TIME EVER attempt we did of playing that song into the ADAT recording deck at our second rehearsal with our new drummer (who isn't even featured in the old picture we used.)
I mean,
what's the damn point of "going forward" with a counter-claim under these circumstances?
After all, even though the recording we made can't be found at YouTube,
it is STILL AVAILABLE at a much BETTER website called "DMusic"
(DMusic had the foresight to have obtained LEGAL rights for its' artists to feature cover tunes!)
And DMusic doesn't play DIRTY with its' users.
My pal leflaw would NEVER build HIS site on the backs of the members creative efforts and then turn around to share all the revenue with the fucking RIAA!
Michael Robertson sorta did that trick with Mp3.com ...but YouTube/Google have done WORSE!

( 17 year old twins ) , they won't have
a clue.

all of their peers, and they won't have
a clue either.
Unless the old man digs out some
of his old band tapes etc ...
I won't be playing or mentioning
Mr Morrison to anyone anymore.
so his wish to be forgotten will soon
be granted here.
He should be more careful in what he wishes for. |

Well, to be fair to "Van the Man" ...I strongly suspect that it was NOT Mr. Morrison himself behind the abusive DMCA take-down notices that are going on IN HIS NAME at YouTube.
(Well, maybe it IS him... but I don't think so.)
This is all HEARSAY... but from what I have been able to gather, Van Morrison has a "retrospective CD/DVD" (?) out this year (or next year?) on POLYDOR records which is owned by Universal.
I THINK that some big-wig at Polydor/Universal is behind the DMCA take-down notices of everything even remotely associated/related to "Van Morrison" over at YouTube...
...even stuff they don't have any copyright claim on WHATSOEVER! |

Lars drunk the RIAA kool-aid too soon and got "stoned" too quick. (I don't "forgive" him, but I at least can understand his early adoption of the evil in comparison to Gene who had lots more time to weigh and measure the true state of things before he came out as being a true prick.) |

of lips, since he uses them to do what
some might call .. sing.

I (being around/among a LOT of the "has-been" music stars from the past who gravitate to places like Dollywood and Branson) can sorta understand what/why/how Van Morrison might "think that way" Dreddsnik.
The man is getting OLD.
He hasn't had a hit in nearly 30 years or more.
He PROBABLY does not know how to find/feel "success" unless signed to a label.
He PROBABLY is just like all the OTHER ex "once-upon-a-time" hit makers around here who don't know HOW to "go indie"
...I understand.

EFF is not interested in anything that doesn't get press coverage first. I've done more than one thing that they told me was impossible.
Universal does not own your sound recording. There is no DMCA violation.

The publishing copyright of the underlying song IS held by Universal (unless they gave it back to Van Morrison as part of his agreement to sign with Polydor last year - a possiblity, tho unlikely because the labels almost never give back their copyrights.)
I'm fairly sure that the DMCA covers publishing copyrights as well as that of audio recordings.
What is "dirty" here is that Universal that "strategic partnership" with YouTube which supposedly allows you to use their stuff in your own vids there. (In that deal, Universal gets a share of YouTube's revenue, but you, the vid creator do not!)
But apparently, Universal gets to pick and choose what is available for use.
It is THIS fact that I wanted to bring to light. YouTube/Universal are having cake and eating it too!

I figured that's how it was going to be. Independent, despite our differences, and we have many I'm sure, I have been in the legal system before; and sadly, I do not have any faith in it, from an insider point of view. I know what it's like to go after an infringer, and I know what it's like to be the target of the lawsuit too.
I have a pessimistic viewpoint on your boycott efforts because I know from first hand experience how futile your efforts really are.
That sad, I have seen you mention a cd-r offering of a particular song. I'm willing to send you a dollar or two for an entire cd-r full of your bands music.
In fact, I'm willing to do a bigger favor than that. How would you like for that cover song morrison cried so much over, to ehh, accidently be leaked all over the place? It's not like you have any control over someone bootlegging you. *hint hint*.

The sound recording is %100 Electric Gypsy's - I promise that we will never sue a fan for sharing our music non-commercially.
If Universal/Van Morrison tries to sue you over a leaked cover tune, well that's THEIR stupid call.
