Napster Back in Court
Napster is back in court, but its not for what you may think. Napster is suing online retailer Sport Service over a copyright dispute. According to a complaint filed in U.S. District Court in San Francisco, Napster alleges that Sport Service is selling t-shirts and caps with Napster's cat-like logo. Sport Service is doing their selling through napsterstore.com, which was purchase on May 24th 2000.
"Sport Service has demonstrated a bad faith attempt to profit," Napster said in the suit, which seeks an injunction and unspecified damages.
Not only has Sport Service "borrowed" Napster's trademarked logo, but they have also borrowed napster.com's design and used a similar one for napsterstore.com. This may be an attempt to make their site look like it is officially a part of Napster Inc.
Sport Service could not be reached for comment, they are closed until January 2nd.

napsterstore.com has been alive and selling merchandise for most of this year. Why didn't they sue them before? Is Napster getting desperate? Gotta love those lawyers...
It's pretty amusing they are suing for intellectual property theft... considering that is Napster's own business plan! ;-) |

either works for Sport Service or the recording industry. :)

Well, sump'n tells me that Napster wouldn't even have a problem if Sport Service weren't turning a profit. Profit is where my line is drawn. No one should be makin' a profit w/their logo without compensating them.
I still hate this legal shit, tho. |

much though i agree that napster is in fact not responsible for any copyright infringement happening as a result of the service's operation;
i think that they really need to take a better look at what they stand for.
information is free.
if you can access it, it is yours.
ah, but to sell the physical merchandise? that's just naughty. it would be like me getting an album's worth of mp3s, burning a disc and selling it! |
