EMusic Attacks Napster

The embattled music sharing service Napster will be facing a new barrage of legal attacks from EMusic. On Wednesday, EMusic filed a copyright infringement suit against Napster accusing it of unfair business practices.

EMusic which bills itself as "the premier source for legitimate MP3s" pays artists for each music download off its subscription-based web site. EMusic is accusing Napster of unfair competition because Napster's business is based upon illegitimate use of copyrighted material.

I am sure that the revenue available from a subscription based Napster would overwhelm Emusic, and therefore why not kill Napster before it has that chance?

This is getting pathetic... i mean people are getting so greedy these days... what it all boils down to is that the RIAA and emusic and all these other places are seeing things like gnutella and imesh popping up and it's pissing them off because they know that there isn't anything that they can do about it so they are just going to sue the shit out of napster... what nap needs to do is say fuck you to bmg pack there bags and head for mexico and operate down there.. this way our greedy ass american courts can't get their hands in on it. Judge Patel or whatever the hell your name is .. i think that you need to go back and review your descion this is a BIG step in the wrong direction! Though it irratates me i know that when napster does have to shut down.. i am happy knowing that there is always somewhere else that i am welcome .. and to napster i thank you for everything that you have allowed me to gather from you ... i also want to thank you for dragging this out for as long as you have... i know that i and millions of other people really appreciate the extra time that we are getting to download music. Shawn ... your a genius... i wish that you would come up with something that would not only kill napster but would be deemed legal in the court systems so that there isn't all this bitching. Once again .. Thank You.

e music is just jealous of Napster because napster makes more than they do and do not charge!!! As ironic as it sounds. The peer to peer model is genious. I hope that
Shawn Fanning will continue to create the most awsome inventions in the world even if he becomes a multi millionaire which he desreves because he was not greedy at all when he released Napster!!
The future of peer to peer is going to be more spectacular than it is today. Companies that benefit from napster I would strongly urge you to fight to keep napster alive this could mean bigger profit and loyal customers!!! Thanks to the greatest internet websight creator Shawn Fanning!!!
P.S. Other programers can learn a lot from Shawn Fanning such as lisening to people on how to improve their service instead of taking it as critism. Thank you!!!

Napster is the best Mp3 sharing program around and i think that Shawn Fanning is the most smart and respected person for making Napster free. I think the Best website is Napster and that it should always be free and why should you pay the Artist if the songs are coming from you not the artist trhere coming off your computer not napster. Napster just makes it easier for you to find other peoples song so fuck paying the artist

Am from Canada . I have been getting music from Napster for a while I have over 350 song now, But I just got ban form Roy Orbison's bitch , because i have songs from from him , wich I dont have but am still ban , looking for another site to get music, and napster thank you , and all of the user that allowed me to share their music with us,

Well the end of Napster is not as close as it once looked this past weekend. At one point, only 186,000 files were available from 3500 users. But as the weekend progressed, there were as many as 1,086,000 file available. Now I realize it is not the pre-filter numbers that we saw, (2,355,000 files) but it is clear that so far Napster has hung in. Regarding the comment about buying music. Well I buy an average of 20 CD's a month. I am a DJ who does weddings etc, and use the Napster service for downloading clean (radio) edits of popular new songs, as well as those which have only been released to radio, and out of print or hard to find classic dance tracks etc. Napster saves me on average (based on 2000 numbers) $1,500.00 in music purchases and I can inturn pass those savings to my clients by offering lower prices. The RIAA in the USA maybe does not realize that through Napster, we DJ's are able to expose people to music that is otherwise unavailable to us, especially us DJ's in Canada. There have been many times I downloaded a song from Napster that was a Top 40 hit, but was unavailable in Canada as there was either no distribution contract in place, or, restrictions due to a duplication of group names. In regards to the recording of song titles from CD by friends, what is the difference between going to a library, borrowing a CD and taking it home and recording it, and recording a shared file from Napster??? Are they both not copywrite infringement??? Are they not both acts in which the record companies are not being compensated for that recording other than the original purchase of the CD by the library (if in fact it was purchased and not a donation), and the CD being originally purchased then duplicated as a MP-3 and then shared by Napster users by a Napster user. File sharing WILL continue. Just it will be different. And unfortunately. It will also be more closely monitored. If the RIAA can show this much clout in the PRE-TRAIL segment of the suit against Napster, imagine what it will be like when the trial REALLY starts. Or what it will be like if (and I hate to say this but based on what the courts havedone so far...) when the RIAA wins their case. Scarey. Scarey thought. Time to take the Napster concept OFF the Continent. Move it's base and head office to a place such as that High Tech Industry island near (brrr) Iceland which would NOT fall under the jurisdiction of the USA Court System, Government, and the Recording Industry Association of America. A Canadian is proposing to do just that, with a subsciption service based on the Napster model. I wish him luck, as well as those with Napster in their futures whatever they may be
