Napster Denied
The federal appeals court has set out that Napster must continue to block the swapping of copyrighted music, marking the latest legal setback for their fading online service.
STATEMENT OF JONATHAN SCHWARTZ, GENERAL COUNSEL, NAPSTER, INC. REGARDING EN BANC APPEAL
Redwood City, CA - June 25, 2001 - "While we are disappointed that the U.S. Court of Appeals for the Ninth Circuit declined to reconsider its February 2001 decision, we recognized going in that rehearing petitions are infrequently granted. That is especially so at this stage of the case, where no trial has yet been held in the underlying case. We will now review our legal options going forward. We will continue to comply with the outstanding injunction. With the launch of the new membership service later this summer, we believe we will put to rest many of the outstanding legal issues."

Is it me, or has anyone else noticed that the so called "Artists" that want to close Napster down are Rich asshole scumbags that already have record contracts and make millions of dollars a year by pumping out crappy albums?
I haven't bought a CD in a long time for 2 big reasons, 1) everything that is out right now pretty much sucks anyways and 2) I'm not made of money.
If ever the recording industry were to put out a semi-decent album by a band that doesn't sound like a cow fart then maybe I'll be inclined to buy it. But I like SONGS, not ALBUMS and since the SONGS I like are not played on the radio, I get them dubbed from a friend that screwed the pooch and bought the album, or I look for it online.
Don't get me wrong, there are TONS of awesome albums out there that are soooo worth the money, but in all fairness....would you really pay money to hear Metallica's crap-ass version of "Turn the Page". Sorry Lars, Sorry James, but that song will forever belong to Bob Seiger. Why don't you go cover a Britney Spears tune while touring with the Backstreet Boys and leave the real music to the professionals. |

I see the points of both arguements in this debate. Despite the courts, I feel that the swapping of music files is legit so long as they are not burned onto a cd as full albums.
The record companies lose nothing in that process. Despite what they say, bands acquire publicity this way. I believe powerful tool has been overlooked for it's mal-intentions. Napster and the big giants heads, should converge on some system of agreement.
I enjoy the songs I listen to and agree most albums are a expensive filler I have the shell out money for.
Sorry Mr. Big record company, you've screwed over my wallet a little more than was needed. |
